These Terms of Use ("Terms") govern your access to and use of the Soft Fish client portal (the "Service") provided by The Soft Fish Inc. ("Soft Fish", "we", "us"). By accessing or using the Service you agree to be bound by these Terms.
You must be at least eighteen (18) years old (or the age of majority in your jurisdiction) to use the Service. Access is granted by email allow-list; only authorized email addresses may sign in. You are responsible for the security of the email account associated with your access and for all activity that occurs under it.
You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
You retain all rights to the documents and other content you upload ("Your Content"). You grant Soft Fish a limited, worldwide, non-exclusive license to store, process, transmit, and display Your Content solely for the purpose of operating and improving the Service for you. We do not sell Your Content or use it to train third-party models on your behalf.
Soft Fish provides a document-organization and storage platform. Nothing in the Service constitutes legal advice, the formation of an attorney-client relationship, or a recommendation of any course of action. For legal advice, consult a licensed attorney in your jurisdiction.
The Service — including its software, design, trademarks, and content provided by Soft Fish — is owned by The Soft Fish Inc. and is protected by intellectual-property laws. Except for the limited rights expressly granted to you under these Terms, no rights are transferred to you.
The Service relies on third-party providers (including Cloudflare, Google, and Resend) for hosting, AI processing, and email delivery. Your use of the Service is also subject to those providers' terms and policies as described in our Privacy Policy. We are not responsible for outages or changes in third-party services.
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if continued provision becomes commercially or technically infeasible. Upon termination, your right to use the Service ends; provisions that by their nature should survive (e.g., disclaimers, limitation of liability) will survive.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION. WE DO NOT WARRANT THAT TRANSLATIONS OR ANY OUTPUTS WILL BE ACCURATE OR ERROR-FREE.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL SOFT FISH BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
You agree to indemnify and hold harmless Soft Fish, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, or expenses arising from (a) Your Content, (b) your use of the Service, or (c) your violation of these Terms.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles.
